Terms of Service

These Terms of Service ("Terms") govern your access to and use of the lsbroker platform and website at lsbroker.com.au (the "Platform"), operated by lsbroker (ABN 41 639 510 740) ("lsbroker", "we", "us"). By creating an account or using the Platform, you ("you", "Subscriber") agree to these Terms.
1.Definitions
- Platform — the lsbroker hosted calculators, dashboard, lead-capture, analytics and related services.
- Subscriber / you — the mortgage broker, brokerage or business that holds an account.
- Calculators — the borrowing, home loan, portfolio, budget, refinance and funding tools made available through the Platform.
- End User / Lead — a member of the public who interacts with a Calculator that you have embedded or shared.
2.The service
The Platform lets you embed branded mortgage calculators on your own website, capture enquiries from End Users, receive those enquiries by email and (optionally) to a connected spreadsheet, and view usage analytics. We may add, change or remove features over time.
3.Eligibility and accounts
You must be at least 18 and authorised to act for the business you register. You are responsible for the security of your login credentials and for all activity under your account. Keep your account details accurate and up to date.
4.Free trial
We may offer a free trial. Unless stated otherwise, a valid payment method is required to start the trial, no charge is made during the trial period, and your subscription will begin automatically at the end of the trial unless you cancel beforehand.
5.Fees, billing and renewal
- Subscription fees are charged in advance on a recurring (monthly) basis through our payment processor, Stripe. We do not store your full card details.
- Your subscription renews automatically each billing period until cancelled.
- Prices are in Australian dollars. We may change pricing with reasonable prior notice; changes take effect at your next renewal.
- You are responsible for any taxes applicable to your purchase.
6.Cancellation and refunds
You may cancel at any time from your dashboard or the billing portal. Cancellation stops future renewals; your access continues until the end of the current paid period. Except where required by the Australian Consumer Law, fees already paid are non-refundable.
7.Your responsibilities
- You must hold and maintain any licences, registrations or authorisations required to carry on your business (including, where applicable, an Australian Credit Licence or appointment as a credit representative), and comply with all laws applicable to you.
- You are solely responsible for any rates, fees, buffers or other figures you configure, and for any advice or recommendations you give your clients. The Platform does not give credit or financial advice.
- You must obtain any consents required to collect and use End User information through the Calculators, and handle that information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
- You must not use the Platform unlawfully, or in a way that is misleading or deceptive to End Users.
8.Calculator outputs are estimates only
The Calculators produce general estimates based on the inputs provided and assumptions that may not reflect a particular lender's policy or an individual's circumstances. They do not constitute credit or financial advice, a loan offer, or an assurance of borrowing capacity. You are responsible for ensuring outputs you present to clients are appropriate and accompanied by suitable disclaimers, and for any reliance placed on them.
9.Lead data and ownership
As between you and lsbroker, enquiry information submitted by your End Users belongs to you. We process and store it on your behalf to provide the Platform, in accordance with our Privacy Policy. You are the entity with the direct relationship to your End Users and are responsible for how you use their information.
10.Intellectual property
We (and our licensors) own all rights in the Platform, including its software, design and content. We grant you a limited, non-exclusive, non-transferable licence to use the Platform and to embed the Calculators on websites you control, for the duration of your subscription. You retain ownership of your own branding, logo and content, and grant us a licence to host and display them to deliver the service.
11.Acceptable use
You must not: resell or sublicense the Platform without our written consent; copy, reverse engineer or attempt to extract our source code; interfere with the Platform's security or operation; or use it to transmit unlawful, infringing or harmful material.
12.Availability and changes
We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation, and may perform maintenance or make changes. We are not liable for unavailability caused by factors outside our reasonable control.
13.Warranties and disclaimers
To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
14.Limitation of liability
To the maximum extent permitted by law, and subject to any non-excludable rights, we are not liable for indirect, incidental or consequential loss, loss of profit, data or goodwill; and our total liability arising out of or in connection with the Platform is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
15.Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your misuse of the Platform, the figures or advice you provide, or claims by your End Users or clients relating to your use of the Platform.
16.Suspension and termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Platform in a way that creates risk or liability. You may terminate by cancelling your subscription. On termination, your licence ends; we may delete your data after a reasonable period in line with our Privacy Policy.
17.Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
18.Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in the dashboard. Continued use after changes take effect means you accept the updated Terms.
